SweetSculpt is fully committed to complying with the Digital Millennium Copyright Act (DMCA) and ensuring that content creators' intellectual property rights are respected. In the event that you believe that your copyrighted work has been uploaded or otherwise infringed upon on our platform, you may submit a DMCA notice to report such infringement. This process is in accordance with the procedures set forth in the DMCA and designed to protect the rights of copyright holders.

DMCA Notice Submission

In order for us to process your DMCA notice effectively, the notice must contain the following elements:

  • A physical or electronic signature of the person authorized to act on behalf of the copyright owner of the material that is allegedly infringed.
  • A description of the copyrighted work that you claim has been infringed, including any registration number or other relevant identifying information.
  • Identification of the material that is claimed to be infringing, including specific URLs or other information that will allow us to locate the material.
  • A statement that the copyright owner or authorized agent has a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  • A statement under penalty of perjury that the information in your notice is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  • Your name, contact information, and your address where you can be reached for further correspondence.

Action Upon Receiving DMCA Notice

Upon receiving your DMCA notice, we will investigate the claim and take action as appropriate. If the claim is verified, we will promptly remove or disable access to the allegedly infringing content and notify the user who uploaded it. Additionally, we may provide the user with a copy of your DMCA notice, including your contact information, to facilitate communication regarding the dispute.

Counter-Notification Process

If you are a user who has had content removed due to a DMCA notice, you may file a counter-notification with the following information:

  • Identification of the material that was removed and the location where it appeared on our platform.
  • A statement made under penalty of perjury, declaring that you have a good faith belief that the content was removed by mistake or misidentification.
  • Your contact details, including your full name, address, phone number, and email address.
  • A statement consenting to the jurisdiction of the United States federal district court for your location, or any jurisdiction where SweetSculpt is located.
  • Your signature.

Restoration of Disputed Material

Once a counter-notification is received, we will forward it to the original complainant, who has the option to take further legal action if they wish. If no such legal action is taken, the disputed material may be restored after a waiting period of 10-14 business days.
